Initial Comments:


Based on the findings of an offsite state relicensure survey completed March 22, 2022, Living Angels Home Care was found to be in compliance with the following requirement of PA Code, Title 28, Health and Safety, Part IV, Health facilities, Subpart A, Chapter 51.

Based on the findings of an offsite state relicensure survey completed March 22, 2022, Living Angels Home Care was found not to be in compliance with the following requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

611.51(a) LICENSURE
Hiring or Rostering Prerequisites

Name - Component - 00
Prior to hiring or rostering a direct care worker, the home care agency or home care registry shall: (1) Conduct a face-to-face interview with the individual. (2) Obtain not less than two satisfactory references for the individual. A satisfactory reference is a positive, verifiable reference, either verbal or written, from a former employer or other person not related to the individual that affirms the ability of the individual to provide home care services. (3) Require the individual to submit a criminal history report, in accordance with the requirements of § 611.52 (relating to criminal background checks), and a ChildLine verification, if applicable, in accordance with the requirements of § 611.53 (relating to child abuse clearance).

Observations:


Based on review of direct care worker personnel files (PF), and staff (EMP) interviews, the agency failed to conduct a face-to-face interview, obtain two satisfactory references, and require the individual to submit to a criminal history report, prior to hiring the direct care worker for two (2) of two (2) personnel files reviewed (PF1-2).

Findings included:

Review of personnel files was conducted on March 15, 2022, from 11:15 a.m. to 11:30 a.m. and March 22, 2022, from 10:30 a.m. to 10:45 a.m.

PF1 was hired on 1/25/2022. PF1 did not contain an interview and contained only one satisfactory reference dated 1/18/2022. PF1's criminal history report was submitted on 2/18/2022. (requirements not completed prior to hire)

PF2 was hired on 8/23/2021. PF2 did not contain an interview and contained only one satisfactory reference dated 6/16/2021. (requirements not completed prior to hire)

Findings confirmed with EMP 1 on 3/22/2022 at 12:30 p.m. during exit conference.






Plan of Correction:

Living Angels Home Care will protect all clients by making sure all employees have had face to face interviews and references checked before working with any clients. All criminal background checks will be performed before any employee can work with a client.

The supervisor will make sure all interviews, references and background checks are completed during orientation and training process. No offer of employment will be extended until these are completed and in employee file.

The Administrator will review files monthly for dates of compliance of reference checks, background checks and interviews against employee date entering clients home. Administration will also quarterly document in the QMP to measure and meet the goals.

Proof of Residency

The home care agency or home care registry may request an individual required to submit or obtain a criminal history record to furnish proof of residency through submission of any one of the following documents:
(1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification.
(2) Housing records, such as mortgage records or rent receipts.
(3) Public utility records and receipts, such as electric bills.
(4) Local tax records.
(5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it.
(6) Employment records, including records of unemployment compensation

Observations:


Based on review of direct care worker personnel files (PF), and staff (EMP) interview, the agency failed to verify proof of residency in Pennsylvania for 2 years prior to date of hire for one (1) of two (2) personnel files reviewed (PF1).

Findings included:

Review of personnel files was conducted on March 15, 2022, from 11:15 a.m. to 11:30 a.m. and March 22, 2022, from 10:30 a.m. to 10:45 a.m.

PF1 was hired on 1/25/2022. There was no documented evidence to verify proof of PA residency for the two years immediately preceding the date of hire.

Finding confirmed with EMP 1 on 3/22/2022 at 12:30 p.m. during exit conference.





Plan of Correction:

Living Angels Home Care will us the system to make sure all employees have submitted a copy of their Identification and/or proof of residency for all new employees. If the employee cannot provide this they will be required to have FBI fingerprinting completed.

Supervisor will make sure during orientation and training that each new employees file includes this information before any employee can attend to a client.

The Administrator will check employee files to make sure dates on the proof of residency and other verification forms have been done before the date they were sent to work with a client. Administration will quarterly review and document information in the QMP to measure and meet goals set.
